Administration Asking Courts to Reinstate Business Vaccine Mandate

WASHINGTON, DC – Last week, the Sixth Circuit Court of Appeals was selected to hear all complaints filed regarding the Biden Administration’s COVID-19 vaccination mandate.

At issue is whether the Occupational Safety and Health Administration (OSHA) has the authority to issue a rule requiring all businesses with 100 or more employees to “develop, implement, and enforce” mandatory COVID-19 vaccination policies. It also requires unvaccinated employees to undergo weekly testing and to wear face coverings in the workplace.

OSHA promulgated the mandate almost three weeks ago as a temporary emergency standard, which allowed it to sidestep typical notice-and-comment proceedings for six months.

Recently the Fifth Circuit Court ordered a halt of the mandate telling OSHA to “take no steps to implement or enforce the Mandate until further court order.” On Tuesday, however, the Administration asked the Court to reinstate the mandate. Any action by the Sixth Circuit likely will result in an appeal to the Supreme Court.
